This is an English translation of the Polish Terms of Service (wcob.pl/regulamin) provided for information; the Polish version is the binding one and in case of any discrepancy it prevails. II. Definitions
- Client - a natural person, a natural person running a business, a legal person or an organisational unit without legal personality that uses the Service or purchases Services (including marketing agencies, SEO agencies, in-house teams, sole traders and Consumers).
- Consumer - a natural person entering into a legal transaction with the Operator that is not directly related to their business or professional activity (art. 22¹ of the Polish Civil Code).
- Sole trader with consumer rights - a natural person entering into a contract with the Operator that is directly related to their business activity, where the content of that contract shows that it is not of a professional nature for them (art. 7aa of the Polish Consumer Rights Act, art. 385⁵ of the Civil Code). The provisions of the Terms concerning Consumers apply to such a person to the extent required by applicable law, in particular the right of withdrawal (§ X) and protection against unfair contract terms.
- Account - the Client's individual, password-protected profile in the Service, available after registration, used to manage Services and the Wallet. The Account is shared with WizytowkiFirmowe.pl, MarketingHotelowy.pl, Wcob.pl and LokalneOgloszenia.com (Single Sign-On).
- Wallet - the Client's virtual prepaid balance expressed in Points (1 Point = PLN 1.00 net), used to purchase Services provided by the Operator.
- Points - settlement units in the Wallet (1 Point = PLN 1.00 net + applicable VAT). Points constitute a single-purpose voucher (SPV) within the meaning of art. 8a(1) of the Polish VAT Act; 23% VAT is charged when the Wallet is topped up.
- Top-up Bonus - free additional Points credited to the Wallet on top-up (in the amount and according to the thresholds published in the Service on the Discounts page and in the Panel). The Bonus is a discount on the price of future Services and is not invoiced separately.
- Loyalty Programme - a system of ranks granted to the Client on the basis of the cumulative net value of Wallet top-ups (Lifetime Spent), calculated per VAT ID. A higher Rank means a higher percentage discount on Service prices, applied when Points are deducted from the Wallet.
- Rank - a level in the Loyalty Programme (levels as currently listed on the Discounts page) depending on Lifetime Spent. Once achieved, a Rank is permanent and does not decrease.
- Lifetime Spent - the total net value of Wallet top-ups made by the Client (per company VAT ID) since they started using the Service, aggregated across the whole WCOB ecosystem (the Service, WizytowkiFirmowe.PL, MarketingHotelowy.PL, DodawarkaOgloszen.pl, LokalneOgloszenia.com).
- Partner Programme - an affiliate programme under which a Client (Partner) receives a Partner Commission on payments made by a Referred Client, in the amount and on the terms published in the Service (Partner Programme page), for the period during which the Referred Client is assigned to the Partner and the Partner Programme is in force.
- Partner - a Client with an active Partner Code, entitled to receive Partner Commissions for referring new Clients.
- Referred Client - a Client who registered in the Service as a result of using a Partner Link (with a valid Attribution Cookie) or a Partner Code entered during registration.
- Partner Code / Partner Link - the Partner's unique identifier (an alphanumeric code and a link in the format
wcob.pl/?ref=CODE) generated in the Partner Panel after successful KYC verification. - Attribution Cookie - a technical mechanism recording the assignment of a prospective Client to a Partner. The cookie is stored in the user's browser after clicking the Partner Link and remains valid for the period specified in the Partner Programme rules published in the Service (wcob.pl/partnerzy).
- Partner Commission - the amount due to the Partner for a payment made by a Referred Client, calculated as a percentage of the net payment amount (excluding VAT) at the rate set out in the current Partner Programme rules published in the Service. Accrued on every subsequent payment by the Referred Client, not only the first one.
- Service - each of the advertising services provided by the Operator in the Service: sponsored article, press mention, banner campaign, NAP listing, multi-portal classified, e-commerce distribution, domain sale, domain brokerage, link in an existing article (niche edit), site-wide link, Publication Package, business visibility care.
- Publication Package - a prepaid pool of a specified number of publications (sponsored articles or press mentions) at a fixed price per unit, with a list of portals fixed at the time of purchase and a validity period stated at purchase. Details in § V.3.
- Purchase without an Account - the purchase of a Service (domain, Publication Package) by a person who does not have an Account, by providing an e-mail address and invoicing details; in that case an Account is created automatically once the payment is booked (§ IV(2)).
- Organisation - a group of Client Accounts linked by the same VAT ID (e.g. employees of one agency) sharing the Wallet, Rank and Publication Packages. The owner of the Organisation is the Account created first or the Account designated by the Operator.
- Portal Network - the set of websites operated or serviced by the Operator and its partners, including WizytowkiFirmowe.PL, MarketingHotelowy.PL, DodawarkaOgloszen.pl, LokalneOgloszenia.com, PracaMiasto.pl and dedicated local domains. The current list is published in the Service.
- End Client - the entity on whose behalf the Client (e.g. an agency) orders Services. The Client independently concludes a separate contract with the End Client and bears full responsibility for it.
- Tpay - the online payment operator: Krajowy Integrator Płatności S.A., Poznań, VAT ID 7773061579.
III. Technical requirements
Using the Service requires:
- a device with Internet access (computer, tablet, smartphone),
- a web browser supporting HTML5, CSS3 and JavaScript ES2020+ (current versions of Chrome, Firefox, Safari, Edge),
- JavaScript and (session) cookies enabled,
- an active e-mail address (for registration and communication),
- for verification features, an active mobile phone number.
IV. Registration, Account and login
- Registration of an Account is voluntary (except for a Purchase without an Account referred to in section 2, where the Account is created as a consequence of the purchase) and free of charge. It takes place via a form in the Service (e-mail + password) or by signing in with a Google account (OAuth 2.0).
- Purchase without an Account: domains and Publication Packages can be purchased without prior registration by providing an e-mail address and invoicing details (company VAT ID or full name). Once the payment is booked, the Operator creates an Account for the e-mail address provided and sends a link to set a password (valid for 7 days); if an Account with that address already exists, the purchase is assigned to it. The buyer accepts the Terms in the purchase form.
- Organisation: a Client (owner of the Organisation) may invite further Accounts to their company; Accounts join the Organisation only by accepting an invitation sent from the owner's Panel (link valid for 7 days). Merely entering a VAT ID already assigned to another Account does not grant access to the Organisation or its funds. Accounts in an Organisation share the Wallet, Rank and Publication Packages; Wallet top-ups are made by the owner of the Organisation, and the other Accounts use the shared balance for their orders. The owner is responsible for the actions of the persons they invited and may disconnect them at any time in the Panel.
- Welcome bonus: the Operator may run a promotion for Clients with a VAT ID under which a Client who completes their company details (full name, phone, VAT ID) and gives consent receives a one-off bonus in Points in the amount shown in the Panel at the time of completing the details. The bonus is granted once per VAT ID, is a discount on the prices of future Services and is not refundable or payable in cash. The promotion may be changed or ended at any time without affecting bonuses already granted.
- After creating an Account the Client gains access to the Client Panel to order Services, top up the Wallet and manage orders.
- An Account is uniquely identified by an e-mail address. The Client must provide true details and keep them up to date.
- The Client is responsible for keeping their password confidential. In the event of a reasonable suspicion that the Account has been compromised, the Operator may temporarily block it.
- The Operator applies login rate limiting (5 failed attempts within 15 minutes from one IP) and two-step SMS verification for selected operations.
- The Client may delete their Account at any time by sending a request to bok@wcob.pl. Unused Wallet funds are refunded to a bank account within 14 days of confirming the request (subject to § VIII(8) and § VII(4) regarding Bonuses).
V. Scope of services
The Operator provides the following Services:
- Sponsored articles - publication of an expert article with external links (the link attribute depends on the publication type, see § IX(6)) on selected portals in the Portal Network. The content may be prepared by the Client or generated with the integrated AI assistant. Every publication is moderated (usually within 1-24 hours) before it goes live.
- Press mentions - publication of a short mention of a brand, company or product within the editorial content of a portal in the Network, without clickable external links. A mention is a public brand mention without a clickable link; the Operator does not guarantee any effect on visibility in search engines or language models. Visibility period: 12 months from publication or indefinitely (lifetime variant), depending on the option chosen. Editorial moderation is mandatory.
- Banner campaigns - display of an advertising banner in horizontal formats (up to 970×250 px, e.g. 728×90, 970×90, 970×250 and responsive mobile versions) in the TOP (header) and BOTTOM (footer) positions of portals in the Network. Format: JPG, PNG, GIF, WebP, SVG, approx. 200 KB max. Static, exclusive position: only one creative of the Client in a given slot during the campaign period (no rotation of competing ads). Reach, prices and volume discounts according to the current price list in the Panel.
- NAP listings - publication of a company profile (Name, Address, Phone) across the local portal network (LokalneOgloszenia.com + MarketingHotelowy.pl). Plans: free (1 portal) and paid (up to several hundred portals with a dofollow link, premium categories, statistics and an AI description). Current plans are published in the Panel.
- Multi-portal classifieds - simultaneous publication of a classified ad on portals in the Network (up to approx. 370 classifieds portals) under the selected Plan. Available plans: Start (50 portals) to Turbo (370 portals) and PRO variants with promotion enabled (top of the list + home page). Publication period: 60 days. The Client receives a visibility report (views, CTR per portal, phone/e-mail/link clicks). Default attribute of external links in classifieds:
nofollow. - E-commerce distribution - automatic daily publication of products from the Client's shop across the Portal Network based on a CSV/XML/Ceneo/Google Shopping feed. Stock and price synchronisation, deactivation of ended products, automatic addition of new ones. Individual quote depending on the number of products, sync frequency, feed format and number of target portals. Delivered under a separate agreement.
- Domain aftermarket - sale of the Operator's own domains and ready-made portals in the catalogue at wcob.pl/domeny and on the pages of individual domains (DoradcaDomenowy.pl). A "Buy now" purchase is possible without an Account (§ IV(2)). The Client may also submit a price offer; the Operator responds automatically (acceptance or a counter-offer with a purchase link of a specified validity). Transfer of the domain (assignment at Aftermarket.pl) or handover of the portal is carried out manually within 24 business hours of the payment being booked, after confirming the buyer's details.
- Domain brokerage - intermediation in acquiring hard-to-obtain domains on the secondary market (negotiation, valuation, escrow, transfer). Delivered on individual order and quote.
- Link in an existing article (niche edit) - adding one sentence with a link to the Client's website to an article already published on a portal in the Network, for 12 months or indefinitely. The sentence is subject to editorial moderation. The product is exposure within content read by the portal's audience.
- Site-wide link - placement of a link to the Client's website in the "Recommended" section visible on every page of the selected portal for the selected period (1 to 12 months). The section is marked as advertising content.
V.1. Business visibility care (subscription service)
- The care service consists of managing the Client's company presence across the Portal Network on a monthly basis (business directory listings, classifieds, news, press mentions, articles, directory promotion, banners) to the extent defined by the selected plan. The current contents and prices of the plans are published at wcob.pl/opieka.php and in the Panel.
- The service is billed monthly in advance, without a fixed-term contract and without a notice period. The Client may cancel at any time with one click in the Panel; the service is then provided until the end of the paid period, after which it expires.
- Content prepared as part of the care service (including with the AI assistant) may be subject to the Client's approval in the Panel. The Client is responsible for the accuracy of the information about their company provided to the Operator.
- After the care service ends, the company's entries return to the state before the service started (free listing) and paid promotions expire.
V.2. Connected external channels (Google Business Profile, Facebook, Instagram)
- A Client using the care service may voluntarily connect their Google Business Profile, Facebook page and linked Instagram account to the Panel by authorising access directly with the provider (OAuth). The Operator does not receive the Client's passwords.
- By connecting a channel the Client authorises the Operator to publish in that channel, on the Client's behalf, only content scheduled as part of the care service and visible to the Client in the Panel. The Operator performs no other actions in the channel (it does not read messages, change settings or delete third-party content).
- The Client represents that they are authorised to manage the connected channel and is liable towards the provider for the compliance of the published content with the provider's terms. Content is published in the wording approved by or made available to the Client in the Panel.
- The Client may disconnect a channel at any time in the Panel (stored access tokens are permanently deleted) or revoke access with the provider. Disconnecting does not affect the remaining part of the care service.
- The availability and operation of connected channels depend on the providers' interfaces (Google, Meta). The Operator is not liable for restrictions, changes or outages on the providers' side or for the providers' decisions regarding the Client's account.
V.3. Publication Packages
- A Publication Package is a prepaid pool of a specified number of sponsored articles or press mentions, in the sizes and at the prices of the current price list, sold in the Service (wcob.pl/artykuly, wcob.pl/wzmianki), also without an Account.
- Each Package has an assigned list of portals on which the publications can be used. The list is presented before purchase and recorded at the time of purchase; later changes to the Network's offer do not change the list of a purchased Package. If a portal on the list ceases to operate, the Operator replaces it with a portal of comparable parameters from the same tier.
- A Package covers publication in the standard variant (article with one link, press mention for 12 months). A more expensive variant (e.g. an article with three links, a lifetime mention) requires payment of the difference in the list price, paid with Points or online.
- An order for a portal outside the Package list is paid for separately (with Points or online) within the same order. Publications from the Package are deducted from the pool when the order is placed; if the publication is rejected in moderation or the payment for the remaining part of the order fails, the units return to the pool.
- A Package is valid for the period stated at purchase, counted from the booking of the payment. Unused publications expire at the end of the validity period; on the Client's request submitted before expiry, the Operator may extend the deadline.
- The Package price is a promotional price: the Rank discount and the Top-up Bonus do not apply to the Package or to the publications drawn from it. The purchase of a Package is documented with a VAT invoice (single-purpose voucher, art. 8a(1) of the VAT Act); drawing a publication from the Package does not generate an additional invoice.
- A Package is assigned to the Account (Organisation) and cannot be resold or transferred to another entity. The Package balance is visible in the Panel ("Packages" tab: remaining publications, deadline, portal list, usage history).
The current list prices of individual Services are published in the Client Panel. Service prices, Top-up Bonus amounts, Rank thresholds and discounts, the Partner Commission rate, promotional bonuses and the sizes and prices of Publication Packages do not form part of the Terms: they are published in the Service (price list, Discounts page, Partner Programme rules, Client Panel) and may be changed without amending the Terms and without the notice period in § XIX. A change does not affect orders already paid for, Points and bonuses already granted or benefits already accrued; the values in force at the time of placing the order, topping up or accruing the benefit are binding. A price change does not affect the current paid period of a subscription Service; for Consumers, applying a new price to the next automatically paid period requires their prior acceptance.
The Loyalty Programme discount (if the Client has a Rank with an accrued discount) applies together with the Top-up Bonus, each at its own stage: the Client receives both benefits, the bonus on topping up the Wallet and the discount on every Service when Points are deducted from the Wallet (details in § XVII).
VI. Prepaid Wallet and Points
- The Client may pay for Services with the prepaid Wallet and, in the cases indicated in the Service, also directly via the payment operator or in a mixed mode (§ VIII). The Wallet is topped up with Points; a Service paid for from the Wallet is settled by automatically deducting the appropriate number of Points.
- 1 Point = PLN 1.00 net. Topping up the Wallet is subject to 23% VAT (e.g. a top-up of PLN 1,000 net = PLN 1,230 gross = 1,000 Points in the Wallet).
- Points in the Wallet constitute a single-purpose voucher (SPV) within the meaning of art. 8a(1) of the VAT Act; all Services in the Service are subject to a uniform 23% VAT rate. The Wallet is intended for transactions for which the place of taxation is Poland and the 23% rate applies; if the place of supply of Services for the Client is outside Poland (in particular a taxable person established abroad), the Operator may refuse to top up the Wallet and settle the Services by direct payment (§ VIII(2)) with an invoice issued under the applicable rules.
- No overdraft: the Client cannot spend more Points than they hold in the Wallet. Every Service paid for from the Wallet requires a sufficient balance at the time of ordering.
- The balance does not expire: Points remain in the Wallet until they are spent on Services or refunded at the Client's request.
- Every Wallet transaction (top-up, deduction for a Service, refund, adjustment) is recorded in an immutable transaction log available to the Client in the Panel ("Wallet → History" tab).
VII. Top-up bonuses
- When topping up the Wallet above specified thresholds, the Client receives additional Points (Top-up Bonus) as a free discount on the prices of future Services. The current top-up thresholds and Bonus amounts are published in the Service (Discounts page: wcob.pl/lojalnosc) and in the Panel before topping up, and are updated in accordance with section 5 of this paragraph; the thresholds in force at the time of the top-up are binding.
- The Bonus is credited to the Wallet immediately after the top-up is booked.
- The Bonus is a trade discount (a discount on the prices of future Services) and is not invoiced as a separate item. The VAT invoice covers only the amount actually topped up (without the Bonus).
- In the event of a refund of Wallet funds at the Client's request, the Bonus is not refundable in cash (it is booked as a free addition of Points). Only Points from the Client's actual payments are refunded, in proportion to the unspent balance. If the balance contains a mix of Points from payments and from the Bonus, the Points from payments are qualified for refund first (FIFO rule relative to the Bonus).
- The Operator reserves the right to change the Bonus thresholds, introduce promotional campaigns or temporarily suspend the Bonus. Such changes do not affect Bonuses already credited to the Wallet.
- The Top-up Bonus applies together with the Loyalty Programme discount (Rank), each at its own stage: the Client receives both benefits when the conditions of each are met (calculation method in § XVII item 7).
VIII. Payments and invoicing
- Payments for Wallet top-ups are handled by the operator Tpay (Krajowy Integrator Płatności S.A.). Available methods: fast online transfers (pay-by-link), BLIK, payment cards (Visa, Mastercard).
- Direct payments: domains, Publication Packages and single publications may be paid for directly via Tpay, bypassing the Wallet, or in a mixed mode (partly with Points, the rest via Tpay). A VAT invoice is issued for the part paid via Tpay; the part paid with Points is settled under the top-up invoice. An order not paid within the validity period of the payment link is cancelled, and the Points and Package publications deducted for that order are returned to the Client.
- Once the payment is booked, Points are added to the Wallet automatically and a VAT invoice is issued within the statutory deadline.
- The VAT invoice is made available in the Client Panel for download as a PDF; at the same time it is sent to the Client's e-mail address and is submitted to the National e-Invoicing System (KSeF) if, under the applicable regulations, it is issued through that system.
- The VAT rate on Wallet top-ups is 23% (standard rate).
- Invoice details (company, VAT ID, address) are taken from the Client's profile in the Panel. The Client is obliged to provide correct invoicing details before making the payment. Errors in issued invoices are corrected in accordance with the applicable tax regulations.
- Deducting Points from the Wallet as payment for a Service does not involve an additional invoice; it is an internal settlement under the top-up invoice already issued (single-purpose voucher).
- Refund of Wallet funds: on the Client's written request (e-mail), the Operator refunds the proportional value of Points originating from actual top-ups (without the Bonus, see § VII). The refund is made within 14 days of confirming the request, to the bank account indicated by the Client. A corrective invoice is issued for the refund.
IX. Content publication rules
- The Client bears full responsibility for the content published as part of the Services (articles, banners, classifieds, listings, End Clients' company data).
- Content must comply with Polish law, good practice and the Terms.
- It is prohibited to publish content that:
- is untrue, misleading or damages the reputation of third parties,
- infringes copyright, trademarks or other intellectual property rights,
- is offensive, vulgar, discriminatory or incites hatred,
- relates to online gambling (other than operators licensed by the Polish Ministry of Finance), pornography, intoxicants, weapons, dietary supplements with illegal content or supplements promising therapeutic effects,
- relates to pyramid schemes, scams, malware or phishing,
- constitutes SEO content of a cloaking, redirect-spam or other nature inconsistent with Google's guidelines,
- links to pornographic, (unlicensed) gambling or drug-related websites or websites containing malware.
- Moderation: sponsored articles and banners are moderated before publication. The Operator may reject a publication with a justification; in that case the payment is refunded in the form in which it was made: Points return to the Wallet automatically, a direct payment is refunded to the Client's account, and a publication drawn from a Publication Package returns to the Package pool.
- If a breach is found after publication, the Operator may withdraw the content from the Network's portals without refunding Points if the breach results from untrue information provided by the Client.
- Labelling of paid publications: sponsored articles, mentions, in-content links and site-wide links are labelled as paid cooperation or sponsored content in the manner adopted on the given portal, in accordance with the regulations on combating unfair market practices (UOKiK) and Google's guidelines on paid content. The Client selects the publication type in the Panel from those currently available; the manner of labelling and the technical parameters of links are determined by the Operator according to the Network's editorial policy, and the Operator may accept or change the Client's choice during moderation. The Operator does not guarantee any effect of publications, links or mentions on search engine rankings; the subject of the Service is the exposure of the Client's content to the audiences of the Network's portals.
- Reporting illegal content and moderation (DSA). To the extent that the Operator provides a hosting service within the meaning of Regulation (EU) 2022/2065 (Digital Services Act) by storing and making available content provided by Clients (articles, mentions, banners, classifieds, listings, comments):
- Notice: any person or entity may report content they consider illegal electronically to bok@wcob.pl (subject: "Content notice") or via the contact form in the Service. The notice should allow the content to be identified (URL or other data), contain an explanation of why it is illegal, and include the notifier's details and the statements required by applicable law.
- Handling: the Operator confirms receipt of the notice and processes it without undue delay, in an objective and non-arbitrary manner, and informs the notifier of the outcome.
- Moderation and statement of reasons: content may be subject to automated technical and anti-spam checks (link limits, word filters), but decisions to refuse publication, remove content or restrict its visibility are verified by a human. Where the Client's content is removed, its visibility is restricted, it is rejected in moderation or otherwise restricted because it is illegal or incompatible with the Terms, the Operator provides the Client (by e-mail or in the Panel) with a statement of reasons to the extent required by the DSA, including the basis for the decision and information on how to contest it at bok@wcob.pl. Content restrictions are set out in this paragraph (sections 2-3).
- Online platform: to the extent that, in respect of a given Service, the Operator meets the definition of an online platform provider and the additional obligations of Section 3 of Chapter III of the DSA apply to it, the Operator also applies the rules provided for there, in particular regarding the internal complaint-handling system and notices from trusted flaggers.
- Point of contact for DSA matters for Member State authorities, the European Commission, the European Board for Digital Services and recipients of the service: bok@wcob.pl (Polish and English).
X. Right of withdrawal (Consumers)
This paragraph applies to a Client who is a Consumer within the meaning of art. 22¹ of the Civil Code and, accordingly, to a sole trader with consumer rights (§ II).
- A Consumer has the right to withdraw from the contract within 14 days of its conclusion without giving any reason.
- Exception: under art. 38(1)(1) of the Polish Consumer Rights Act, the right of withdrawal does not apply if the Operator has fully performed the Service with the express prior consent of the Consumer, who was informed before performance began that they would lose the right of withdrawal once the Service had been performed, and acknowledged this. The Consumer gives this consent and acknowledgement in the order form before confirming the order. This applies in particular to the publication of an article, mention, banner or classified (once actually published in the Network). Unused Points in the Wallet are refundable under § VIII(8) regardless of the withdrawal deadline. Until the Service has been fully performed the Consumer may withdraw from the contract; if the Consumer expressly requested that performance begin before the withdrawal period expired, the Operator refunds the payment less the value of the performance provided up to the moment of withdrawal (art. 35 of the Consumer Rights Act).
- The Consumer submits the withdrawal statement by e-mail to bok@wcob.pl. A model withdrawal form is available in the Annex to the Consumer Rights Act.
- Publication Packages and domains: a Consumer may withdraw from the purchase of a Package within 14 days provided they have not drawn any publication from it; after a publication has been drawn, the refund covers the value of the unused units at the Package's unit price. A domain sale contract is performed when the domain is transferred (assigned) to the Consumer. An assignment before the withdrawal period expires takes place only at the express request of the Consumer, who was informed before the assignment that they would lose the right of withdrawal once it had been carried out and acknowledged this; after the assignment the right of withdrawal does not apply.
- In the event of an effective withdrawal, the Operator refunds the payments received from the Consumer (without the Bonus) within 14 days of receiving the statement.
- A Client who is neither a Consumer nor a sole trader with consumer rights (in particular companies and businesses entering into a contract of a professional nature) does not have the right of withdrawal under the Consumer Rights Act. Refunds of Wallet funds are made under § VIII(8).
XI. Complaints
- Complaints regarding the Services provided, the operation of the Service or Wallet charges are submitted by the Client electronically to bok@wcob.pl.
- A complaint should include: the order/transaction identifier, a description of the problem, the expected resolution and the Client's contact details.
- The Operator handles the complaint within 14 days of receipt and informs the Client of the decision by e-mail.
- If the complaint is upheld, the Operator returns Points to the Wallet, corrects the Service or refunds the funds, in accordance with the Client's request and the nature of the complaint.
XII. Out-of-court dispute resolution (Consumers)
A Consumer may use out-of-court methods of handling complaints and pursuing claims, including:
- mediation conducted by the Provincial Inspector of Trade Inspection,
- a permanent consumer arbitration court,
- assistance from the district (municipal) consumer ombudsman.
The register of entities authorised to conduct out-of-court consumer dispute resolution is kept by the President of the Polish Office of Competition and Consumer Protection (uokik.gov.pl). Using these methods is voluntary for both parties.
XIII. Security rules and prohibited actions
The Client undertakes to use the Service in accordance with its purpose and applicable law. The following is prohibited:
- unauthorised access to the Service, other Clients' accounts or the Operator's infrastructure,
- introducing malware, exploits or scripts that overload servers (DoS),
- circumventing security measures (CSRF, rate limiting, data validation) and crawling/scraping the Service beyond the public sitemap and robots.txt,
- creating Accounts with false details or multiple Accounts of the same Client in order to circumvent limits or Bonuses,
- compromising the security of End Clients (phishing using NAP listings, fake classifieds).
The Operator applies technical and organisational measures to secure the Service (HTTPS/TLS, bcrypt password hashing, rate limiting, audit logs, backups, access management). If a breach is detected, it may temporarily block the Client's Account and request an explanation.
XIV. Liability
- The Operator is not liable for content published by Clients (articles, banners, classifieds, listing data, End Clients' content); this liability rests with the Client under § IX.
- The Operator exercises due care to ensure the continuity of the Service and the Portal Network but does not guarantee 100% availability (e.g. due to maintenance, hosting failures, Internet network failures, force majeure).
- The Operator is not liable for the effects of ad blockers, browsers or other software on the side of visitors to the Network's portals. Banner impression statistics reflect actual impressions after filtering.
- Figures such as the number of portals, Network traffic and campaign results quoted in marketing materials are indicative. Specific results depend on the quality of the content, the industry, seasonality and other factors beyond the Operator's control.
- The Operator's liability towards a Client who is neither a Consumer nor a sole trader with consumer rights is limited to the value of the Service/Points to which the claim relates and does not cover lost profits or indirect damage. This limitation does not apply to damage caused intentionally.
- The Operator is not liable for data retrieved automatically from external sources (Google Places API, Wayback Machine, Ahrefs) used in informational Services.
XV. Personal data protection
Personal data of Clients and company data (End Clients) managed in the Service are processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Polish Personal Data Protection Act. The detailed rules are described in the Privacy Policy, which forms an integral part of these Terms. Where the Client enters personal data of third parties into the Service (in particular data of End Clients serviced by an agency), the Operator processes them as a processor under Annex 1 to the Terms (Data Processing Agreement), which the Client accepts together with the Terms.
Company data published in NAP listings, classifieds and sponsored articles are public by design: by publishing such content the Client consents to its indexing by search engines and its visibility across the Portal Network.
Instructions for deleting data and the Account and disconnecting external channels (Google, Facebook, Instagram) are available at wcob.pl/data-deletion.
XVI. Copyright
- The Client represents that they hold all necessary rights to the content (text, photos, graphics, banners, logo, company data) they submit for publication.
- Upon ordering a Service the Client grants the Operator a non-exclusive, territorially unlimited, royalty-free licence to the content for the period of the Service and for 12 months after its end (for archival, audit and SEO purposes) in the following fields of exploitation: recording and reproduction by digital means, entering into the memory of computers, servers and IT systems of the Operator, making available to the public online in such a way that everyone can access the content at a place and time of their choosing (in the Portal Network and channels linked to it), and technical adaptation of the content to publication requirements (resizing and reformatting graphics, text formatting, excerpts and teasers) without changing its meaning. The licence includes the right to grant sub-licences to entities operating portals in the Portal Network.
- Content generated by the AI assistant is provided to the Client "as is". The Client must verify its factual accuracy before publication. The Operator is not liable for AI content infringing third-party rights if the Client knowingly published it.
- The WCOB logo, the Service layout, the source code and brand assets are protected by copyright in favour of the Operator.
XVII. Loyalty Programme (Ranks)
- The Operator runs a Loyalty Programme available to Clients with a VAT ID (Rank and Lifetime Spent are calculated per VAT ID), under which the Client is granted a Rank based on the cumulative net value of Wallet top-ups (Lifetime Spent) calculated per the Client's VAT ID.
- The current Rank thresholds and the discounts on Service prices assigned to them are published in the Service (Discounts page: wcob.pl/lojalnosc) and in the Client Panel; the Rank discount in force at the time Points are deducted from the Wallet is binding. Thresholds and discount rates may change in accordance with section 9 of this paragraph.
- Lifetime Spent aggregates payments across the whole WCOB ecosystem (WCOB.pl, WizytowkiFirmowe.PL, MarketingHotelowy.PL, DodawarkaOgloszen.pl, LokalneOgloszenia.com) per the Client's VAT ID. Accounts of different brands linked by the same VAT ID are treated as one Client for Rank purposes.
- Lifetime Spent does not include the Top-up Bonus, Partner Commissions (if credited to the Wallet) or refunded funds. Only the actual net payment amount resulting from the VAT invoice counts.
- The Rank discount is applied when Points are deducted from the Wallet as payment for a Service: the list price of the Service is reduced by the Rank discount percentage.
- A Rank is permanent and does not decrease: once achieved by the Client it is retained forever, regardless of later payments or periods of inactivity. New payments increase Lifetime Spent and may raise the Rank to a higher level but do not lower the current one.
- Combined application with the Top-up Bonus: the Top-up Bonus and the Rank discount apply together, each at its own stage: the Bonus increases the number of Points on top-up, the Rank discount lowers the Service price in Points when they are deducted. The two percentages are not added together. The actual cost of a Service in PLN is: list price × (1 − Rank discount) ÷ (1 + Bonus). Example: with a +20% Bonus and a −12% Rank, a Service priced at 100 Points costs 88 Points, which corresponds to PLN 73.33 of net top-up, i.e. 26.7% less than without the Programme.
- The Rank discount covers all Services paid for with Points from the Wallet. The Operator may exclude the Rank discount for selected time-limited promotions, special packages or Services with an individually negotiated price; this information is given in the Panel before the order is confirmed.
- The Operator reserves the right to change Rank thresholds and discount rates and to add or remove levels. Changes do not revoke Ranks already granted and do not reduce discounts already applied to Services paid for before the changes take effect.
XVIII. Partner (affiliate) Programme
- The Operator runs a Partner Programme under which a Client (Partner) may recommend the Service to other entities and receive a Partner Commission on payments made by Referred Clients.
- Conditions of participation:
- an active Account in the Service,
- full KYC verification of the company (VAT ID verified in the Polish Ministry of Finance VAT register, complete details: company name, address, postcode, city),
- acceptance of the Partner Programme rules (this paragraph),
- After successful verification the Partner generates in the Panel a unique Partner Code and a Partner Link in the format
wcob.pl/?ref=CODE. Each Partner may have only one active Code (changing the Code later requires the Operator's consent). - Attribution Cookie: after clicking the Partner Link, a cookie containing the Partner identifier is stored in the user's browser. The cookie is stored at the user's explicit request (clicking a link with a referral parameter) and is strictly necessary to provide the service the user has thereby requested, i.e. assigning them to the Partner (art. 399(3) of the Polish Electronic Communications Law); the cookie contains only the Partner identifier and is valid for the period specified in the Partner Programme rules in the Service (wcob.pl/partnerzy). If the user registers in the Service within that period, they are assigned to the Partner. After the cookie expires no assignment is created (unless the user clicks the Link again or enters the Partner Code during registration).
- Benefit for the Referred Client: on their first Wallet top-up the Referred Client may receive an additional bonus in Points (on top of the standard Top-up Bonus) in the amount published in the Partner Programme rules in the Service. The partner bonus is additive with the Top-up Bonus and applies only to the Referred Client's first payment.
- Partner Commission: the Partner receives a percentage commission on the net value of every payment made by the Referred Client (rate published in the Partner Programme rules in the Service), not only the first one: for the period during which the Referred Client is assigned to the Partner and the Partner Programme is in force, in accordance with the current Programme rules. A direct purchase by the Referred Client (domain, Publication Package, publication paid for online) also counts as a payment, in the amount of the net sum paid via Tpay.
- Commission statuses:
- pending - for the buffer period specified in the Partner Programme rules, counted from the Referred Client's payment, as a buffer for a possible refund or complaint,
- approved - after the buffer period, ready for payout,
- paid - after the payout has actually been made at the Partner's request.
- Two payout routes (selected in the Panel):
- WCOB Wallet credit - transfer of the Commission as Points to the Partner's Wallet (1 Point = PLN 1 net). No minimum amount. Processed within 1 business day of the request.
- Bank transfer - after the Partner issues an invoice or another accounting document required by law. The minimum payout amount is set out in the Partner Programme rules in the Service. Processed within 3-5 business days of receiving the document.
- Tax settlement: the Partner Commission constitutes the Partner's business income. Commissions are settled in accordance with the Partner's tax status and applicable law; the Partner is responsible for issuing an invoice or another required accounting document and for correct accounting and tax treatment (PIT/CIT, VAT). Settlement of the Commission in Points (Wallet credit) does not release the Partner from their tax and documentation obligations.
- Prohibited practices:
- Self-referral - referring oneself (a second or further account of the same VAT ID, IP, household or capital group). The system detects self-referral attempts by VAT ID, IP, e-mail and phone; this results in the Commission being revoked and may lead to the blocking of the Partner's and the Referred Client's accounts.
- Brand bidding - bidding in Google Ads, Bing Ads, Facebook Ads and other advertising systems on keywords containing the names WCOB, wcob.pl, Lokalne Ogłoszenia, Marketing Hotelowy, Wizytówki Firmowe, Doradca Domenowy, Dodawarka Ogłoszeń and their obvious variations (typo squatting).
- using the Operator's logos or brand materials without written consent (other than the standard promotional materials made available in the Panel),
- spam (e-mail, phone, SMS, comments) containing the Partner Link; compliance with the GDPR and the Polish Act on Providing Services by Electronic Means is required,
- publishing untrue information about the Service, guarantees of results, false statistics or misleading marketing materials.
- The Operator reserves the right to change the Commission rate, the Attribution Cookie duration, payout thresholds and other parameters of the Partner Programme. Changes apply to Commissions accrued after the changes take effect; Commissions already accrued (pending/approved/paid) are settled under the previous rules.
- The Operator reserves the right to temporarily suspend or terminate the Partner Programme with 30 days' notice. If the Programme is terminated, accrued Commissions are paid out under the general rules and new payments by Referred Clients do not generate further Commissions.
XIX. Amendments to the Terms
- The Operator may amend the Terms for important legal (change of law), organisational, technical or business reasons (extension of the scope of Services).
- A new version of the Terms is published in the Service (Terms page, with version history and a permanent address for each version) at least 14 days before it takes effect, indicating the effective date and the scope of changes. Publication in the Service constitutes notification of Clients of the change; the Operator additionally informs Clients of material changes by e-mail to the Account address or by a notice in the Panel, and informs Clients who are Consumers by e-mail to the Account address. Until the new version takes effect the previous version applies, and orders placed before that date are governed by the version in force on the day of the order. For continuous (subscription) Services, e.g. listing care, the new version applies from the first billing period starting after its effective date; a Client who does not accept the changes may terminate such a Service with effect at the end of the current billing period.
- Amendments to the Terms do not affect Clients' acquired rights arising from Services already paid for and Points in the Wallet.
- Non-acceptance of the amendments entitles the Client to request a refund of unused Points within 14 days of publication of the changes, under § VIII(8).
XX. Final provisions
- Matters not covered by the Terms are governed by Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act, the GDPR and the VAT Act.
- Disputes arising from the Terms between the Operator and a Client who is neither a Consumer nor a sole trader with consumer rights are resolved by the court having jurisdiction over the Operator's registered office (Warsaw).
- Disputes with a Consumer are resolved by the court having jurisdiction under the Polish Code of Civil Procedure (the court of the Consumer's place of residence or the place of performance of the contract, at the Consumer's choice).
- If any provision of the Terms is found invalid or unenforceable, the remaining provisions remain in force.
- This version of the Terms applies from 1 October 2026 and replaces the version in force from 12 May 2026. Orders placed before that date are governed by the version in force on the day of the order, and subscription Services by the rule in § XIX(2). Previous versions with their periods of validity are available in the version history on the Terms page in the Service.
Annex 1. Data Processing Agreement
This Annex constitutes a data processing agreement within the meaning of art. 28(3) GDPR between the Client (as the data controller, the "Controller") and WCOB Sp. z o.o. (as the processor, the "Processor"). The agreement is concluded upon acceptance of the Terms and applies whenever the Client enters personal data of third parties into the Service.

The Processor processes the entrusted data solely for the purpose of providing the Services ordered by the Controller in the Service: managing and publishing business listings (NAP), publishing articles, mentions, classifieds and advertising campaigns, business visibility care, servicing connected external channels (Google Business Profile, Facebook, Instagram), generating content with the AI assistant, reporting and settlements.

The Processor informs of the intended addition or replacement of a sub-processor by updating the Privacy Policy at least 14 days before the change; the Controller may object within that period, which is equivalent to terminating the Services affected by the change. The Processor imposes on sub-processors data protection obligations corresponding to this agreement and is liable for their actions as for its own.

On request made before deletion, the Processor provides the Controller with an export of the data from the Panel.
- Liability. The liability of the parties for breaches of data protection law is governed by art. 82 GDPR. The limitation of liability in § XIV of the Terms applies to the extent permitted by mandatory law.
